Selon la Loi tchèque sur les licences commerciales (loi n ° 455/1991 Coll.), l'activité commerciale est menée systématiquement, individuellement, sous son propre nom, sous sa propre responsabilité, dans un but lucratif et dans les conditions prévues par la présente loi. Les différentes professions nécessitant une licence commerciale sont répertoriées dansannexes 1- 4 de la loi tchèque sur les licences commerciales. Les métiers sont divisés en vertu de la loi tchèque sur les licences de commerce (loi n ° 455/1991 Coll.) en opérations à déclaration obligatoire (Licence de libre-échange tchèque avec domaines d'activités ), qui peut être obtenue sur la base d'une notification - commerce sans réserve avec des objets commerciaux: fabrication, commerce et services non spécifiés dans les annexes 1 à 3 de la loi sur les licences commerciales, et métiers de concession , qui ne peut être exercée que sur la base d'une licence commerciale spéciale - une concession. Les métiers à déclaration obligatoire sont classés en trois autres groupes: professionnel, professionnel et autorisé.

Afin d'acquérir la concession pour les commerces concessionnaires, il est nécessaire de démontrer l'éligibilité professionnelle pertinente et, dans certains cas, de répondre également à certaines exigences supplémentaires. Les métiers qui nécessitent des concessions comprennent l'exploitation d'une agence de voyages, le transport routier de marchandises ou une entreprise de sécurité employée pour protéger les biens d'autrui.

Conditions générales pour exercer un métier tchèque

 
Les conditions générales applicables à une personne physique exerçant un métier sont: avoir atteint l'âge de 18 ans, avoir la pleine capacité juridique et un casier judiciaire vierge. Selon la loi, une personne ayant un casier judiciaire vierge est une personne qui n'a pas été définitivement condamnée pour avoir commis intentionnellement un acte criminel, s'il a été commis dans le cadre d'activités commerciales, ou avec l'objet commercial pour lequel elle demande ou notifie, à moins qu'ils ne soient désormais considérés comme n'ayant pas été condamnés pour une telle infraction.
 

Admissibilité professionnelle

 
Parallèlement au formulaire, dans le cas d'un commerce ou d'une concession professionnelle ou professionnelle, le notifiant ou le demandeur doit présenter un document attestant son éligibilité professionnelle au métier concerné, ou du représentant responsable désigné, accompagné de sa déclaration signée attestant qu'il / elle consent au rendez-vous. La signature sur la déclaration doit être officiellement certifiée. Si les documents sont dans une langue étrangère, ils doivent être traduits en tchèque par un traducteur assermenté ( liste de traducteurs assermentés tchèques ), à l'exception des documents présentés par des ressortissants des États membres de l'UE ou par une personne morale ayant son siège statutaire, son administration centrale ou son principal établissement dans un État membre de l'UE, sauf en cas de doute l'exactitude de la traduction.
 

Autres termes et conditions

 
En outre, un document attestant la base juridique de l'utilisation des locaux sur lesquels le professionnel a situé son établissement (par exemple un contrat de location) doit être soumis, ainsi qu'un reçu pour le paiement des frais administratifs, qui est de 1000 CZK (EUR 40) doit être soumis. Une personne physique étrangère, à l'exception des ressortissants des États membres de l'UE ou d'un État partie à l'accord sur l'Espace économique européen, ou à la Confédération suisse, doit joindre à sa notification d'une demande de commerce ou de concession un document attestant qu'elle a été accordée un visa pour rester plus de 90 jours ou avoir eu leur permis de séjour de longue durée. Une personne physique étrangère doit en outre fournir un extrait du casier judiciaire ou un document équivalent délivré par le tribunal compétent ou l’autorité de l’État du pays dont la personne est ressortissante; l'extrait ne doit pas dater de plus de trois mois.
 
Le bureau du commerce est tenu de procéder à l'inscription au registre du commerce dans les 5 jours ouvrables suivant la réception de la notification et de délivrer à l'entrepreneur un extrait si le notifiant remplit les conditions énoncées dans la loi sur les licences commerciales. En ce qui concerne les concessions, le Bureau du commerce se prononcera sur la question dans les 30 jours suivant la réception de la demande, à condition que toutes les informations pertinentes soient remplies. Par la suite, dans les 5 jours ouvrables suivant l'entrée en vigueur de la décision d'octroi de la concession, une inscription est faite au registre du commerce et un extrait est délivré à l'entrepreneur.
