Ownership of data and access to data in Czech Republic, digital European market
The digital single market is one of the European single market sectors that covers digital marketing, e-commerce and telecommunications, and is one of the main priorities of the Europe 2020 Strategy and its Digital Agenda. So far, this strategy achieved several improvements in digitalization of Europe in 2016 and 2017, for example a cancellation of roaming charges and partial digitization of public administration.
The very highlight of the whole strategy is probably a regulation, which was approved in the form of a regulation both by the European Parliament and by the Council on November 9, 2018, that aims to remove all obstacles to the free flow of non-personal data within the EU. This regulation will be a directly applicable in all the Member States of the European Union, six months after its adoption.
The Regulation aims, in particular, to improve Europe's competitiveness, support a data-based economy and accelerate the development of new technologies such as cross-border autonomous systems and artificial intelligence. The regulation prevents Member States to restrict by the law by any national legislation placement, storage and processing of non-personal data with respect to the geographical area unless such a restriction is justified by national public security. Member States authorities will also have access to data located in another Member State, which may be necessary for regulatory control or oversight purposes.
The digitization of the EU is part of the long-term plan of the European Commission. On April 10, 2018, the second year when the so-called “Digital Day” was held, where 4 declarations were signed by EU Member States, and also by representatives of Norway and Switzerland. Namely, it is a Declaration on Artificial Intelligence, Declaration on European Partnership on Blockchain Technology, Declaration about Collaboration in Genomics and Personalized Medicine, and the "Radar of Innovation" project. The Czech Republic joined all four declarations.
