Ever since the beginning of his studies, Petr Běhan has been specializing in competition law, cartel law, public procurement, European law and advisory services for Czech and foreign entrepreneurs not only in commercial and civil matters, but has been representing them in judicial and arbitration proceedings. In addition to advocacy, Petr Běhan is also active as an arbitrator, and also as an advisor to the Chairman of the Office for the Protection of Competition in the area of competition and public procurement (as the member of appeal committees). Since 1999, he has published more than 90 monographs, articles, expert analyzes and essays - especially in publishing houses Prospektrum and Key Publishing and in professional journals Business Law, Lawyer, Legal Forum, Energy, Insurance Horizon, Insurance Debates, Judicial Practice, Public Administration, Czech industry etc.
Competition law. Member of the appeal committee of the Office for the Protection of Competition
Petr Běhan provides legal advice mainly in the area of competition law, mergers of competitors – assessments of mergers, approvals from the Office for the Protection of Competition, and represents clients before the Office for the Protection of Competition, solves disputes related to abuse of dominant position in the market and assesses contracts and contractual arrangements in view of prohibited clauses in both vertical and horizontal contractual relationships. As an advisor to the Chairman of the Office for the Protection of Competition in the area of competition and public procurement and a member of the appeal commissions of the Office for the Protection of Competition, he has practical experience in cartel agreements and in assessing the concerted conduct of competitors, which might result in the distortion of market competition.
Public procurement
As an attorney-at-law, Petr Běhan has extensive experience in the field of public procurement, concession procedures and in all other types of procurement proceedings under the Public Procurement Act. He advised on the administration of all types of procurement procedures; and also participated in the preparation of all necessary documentation for the tender and helped his clients both in disputes with the subsidy provider (contracting authority), as well as with suppliers and other tenderers. He is able to ensure the organization of tenders according to the procedures specified in the Public Procurement Act.
Public support law
As an attorney-at-law, he also provided legal advice to clients in the field of public support proceedings, legal frame on the management of public funds and the application of rules of the European Union subsidies. Petr Běhan provides advisory and consultancy services in terms of public support and subsidy law, proposes suitable solutions including preparation of contractual documentation according to European Union rules, and is able to represent his clients in negotiations and proceedings in front of the Office for the Protection of Competition or in front of the European Commission.
Arbitration proceedings
Petr Běhan has been an arbitrator of the Arbitration Court attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic since 2018 and, in addition to being an active arbitrator, he represents both Czech and foreign clients in arbitration proceedings before this arbitration court.
